Terms of Service

These Terms of Service (“Terms”) govern access to and use of ClassPods (the “Service”) by teachers, schools, and other authorized users (“you”). By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a school or organization, you confirm you are authorized to bind that organization, and “you” includes that organization. If you do not agree, do not use the Service.
Who may use ClassPods
ClassPods is intended for educators and school staff who are adults able to enter into a binding agreement, and for students participating under a teacher’s or school’s direction. Teacher and administrator accounts are for adults. Students typically join live games and assignments with a room code or share link and do not need to create an account; where student accounts are used, they are provisioned and supervised by the teacher or school. Use of the Service must comply with applicable law and any policies of the school under whose authority it is used.
Accounts and security
You must provide accurate registration information and keep your login credentials secure. You are responsible for activity that occurs under your account. Notify us promptly at hello@classpods.org if you suspect unauthorized access. We may suspend or limit access if we detect abuse, fraud, security risk, or a material violation of these Terms.
Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- upload or share content that is unlawful, infringing, harassing, hateful, or inappropriate for a classroom setting;
- attempt to access accounts, data, or systems you are not authorized to access, or probe, scan, or circumvent security or usage limits;
- interfere with or disrupt the integrity or performance of the Service, or introduce malware or harmful code;
- scrape, resell, or sublicense the Service, or use it to build a competing product, except as permitted by law;
- misuse AI features to generate prohibited, deceptive, or harmful content.
Your content
You retain ownership of and responsibility for the quizzes, lesson packs, assignments, and other material you create or upload (“Your Content”). You represent that you have the rights needed to use Your Content in the Service. You grant ClassPods a limited, non-exclusive license to host, process, display, and deliver Your Content solely to operate and provide the Service to you and your students, and — where you choose to publish to the community library — to make it available as described below. We do not claim ownership of Your Content.
AI-assisted features
ClassPods offers AI-assisted drafting of quizzes, lesson packs, and worksheets through third-party model providers. Prompts you submit are sent to those providers to generate output; we do not opt our usage into provider model training. AI output may be inaccurate or incomplete — you are responsible for reviewing and editing it before classroom use. See our Privacy Policy for the providers involved.
Community library
Content created on the Free plan may be published to the ClassPods community library with attribution, as described during signup and in-product. Paid plans default new content to private unless the author chooses to share it. By publishing to the community library, you grant other users a license to use and adapt that content within ClassPods. You can request removal of content you authored at any time.
Plans, billing, and refunds
- Free plan: available at no cost with monthly usage limits (for example, on homework sends and AI generations). No card is required and it does not expire. When a monthly limit is reached, affected actions pause until the counter resets or you upgrade; existing data remains accessible.
- Pro Monthly: cancel anytime — your next charge stops when you downgrade, and access continues through the paid period.
- Pro Annual: billed yearly. You may request a full refund within 14 days of the initial purchase. After 14 days, a pro-rated refund is available if the cancellation is teacher-initiated and the account has under 30 days of usage in the billing period.
- Schools: typically a one-year contract with a single annual invoice for all teacher seats, payable by bank transfer or card. School pricing, renewal, and terms may also be governed by a separate order form or procurement document, which controls in the event of a conflict with these Terms.
Payments are processed by Stripe. Prices may be displayed in multiple currencies; the charge currency and any foreign-exchange handling are as shown at checkout and by your bank. Except as stated above or required by law, fees are non-refundable. We may change prices on a prospective basis; changes do not affect the current paid period of an active subscription.
Intellectual property
The Service, including its software, design, and branding, is owned by ClassPods and its licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted. Feedback you provide may be used to improve the Service without obligation to you.
Third-party services
The Service relies on third-party providers (for example, hosting, payment, email, and AI providers). Your use of the Service may be subject to those providers’ terms, and we are not responsible for third-party services outside our control.
Availability and changes
We aim to keep ClassPods available and reliable, but we do not guarantee uninterrupted or error-free service. We may add, change, suspend, or remove features over time. Where a change materially reduces core functionality of a paid plan, we will act reasonably and in line with the refund terms above.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will meet your requirements or that AI-generated content will be accurate.
Limitation of liability
To the maximum extent permitted by law, ClassPods will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill. Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amount you paid to ClassPods for the Service in the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
Indemnification
You agree to indemnify and hold ClassPods harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights, except to the extent caused by ClassPods.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for violations of these Terms, misuse, non-payment, or security risk. On termination, your right to use the Service ends; export and deletion of your data are handled as described in our Privacy Policy. Terms that by their nature should survive (such as content licenses for published community content, intellectual property, disclaimers, and limitations of liability) survive termination.
Governing law
These Terms are governed by the laws applicable to the ClassPods operating entity, without regard to conflict-of-law rules. For school customers, the governing law and venue stated in a signed order form or procurement agreement control. Nothing in these Terms limits mandatory consumer-protection rights you may have under your local law.
Changes to these Terms
We may update these Terms as the Service and our legal posture evolve. Material changes are reflected on this page and the “last updated” date is revised. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
